The petitioner is languishing in custody since 08.01.2015 in a case registered for the offences punishable under Sections 420, 467, 468 of the Indian Penal Code, sections 103, 104 of Trade Mark Act and sections 63, 64, 65 of the Copy Right Act. Duplicate pesticides in the brand name of Buyer Crop Science India Ltd were recovered from the shop of the informant.
It is submitted by learned counsel for the petitioner that the petitioner is not manufacturer of the same, moreover, the seized pesticide has not been put to chemical examination.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.10029 of 2015 (02) dt.19-03-2015 2/2 petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (M) P.S. Case No. 09 of 2015. The learned court below will be at liberty to cancel the bail bonds of the petitioner, if the petitioner fails to cooperate in the investigation. (Dinesh Kumar Singh, J) DKS/- U T
