The petitioner apprehends his arrest in connection with Shikarpur P.S. Case No.685 of 2021, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307 and 379 of the Indian Penal Code.

The petitioner is said to have assaulted Ajay Kushwaha causing injury on his head.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that earlier petitioner had filed a case against the informant and thereafter the present case

Patna High Court CR. MISC. No.34423 of 2022(2) dt.27-09-2022 2/2 has been filed by the informant. It is submitted that no specific overt act is alleged against the petitioner. It is also submitted that it is not mentioned in the FIR that the petitioner assaulted Ajay Kushwaha by which weapon.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
