The petitioner seeks bail in a criminal prosecution registered under Sections 363, 366-A/34 of the Indian Penal Code. Taking into consideration the fact that the petitioner is named in the F.I.R. vide Annexure-1, as an accused, and further taking into consideration the fact that the victim, a minor girl aged about 15 years, has supported the prosecution version in her statement recorded under Section 164 Cr. P.C., vide Annexure-2 and showing therein the complicity of the petitioner in commission of the crime in question, his prayer for bail in connection with Kanhauli P.S. Case No. 12 of 2014, pending in the court of learned Chief Judicial Magistrate, Sitamarhi, is rejected for the present.
However, the petitioner shall be at liberty to renew his prayer for bail after completion of one year in judicial custody if trial does not conclude within that period.
