Petitioner is not named but in course of investigation, his name surfaced in this case and allegedly, looted mobile was recovered from conscious possession of the petitioner but there is nothing on the record to show that seized mobile had been put on Test Identification Parade nor the name of the company of the aforesaid mobile has been given in the first information report. The petitioner does not have any criminal antecedent and having more or less similar allegation, one co-accused has already been granted privilege of bail by a coordinate bench of this court.
