JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-12-2020 The office has pointed out several defects to which learned counsel of the petitioner assures that he shall remove the defects within four weeks from the date when the court starts physical function.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 23.04.2020 in a case registered in connection with Falka P.S.Case No. 141 of 2020 for the offences punishable under Sections 307, 353,188 of the Indian Penal Code.

The accusation against the petitioner is that he dashed the barrier put by the police officials causing injury of one constable by his vehicle. Petitioner does not have any criminal

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on provisional bail till removal of the defects on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Katihar in connection with Falka P.S. Case No. 141 of 2020. It is made clear that if the defects, as pointed out by the office are removed within the above stated period, the provisional bail of the petitioner shall be deemed to be confirmed.
