The petitioners seek bail in Nawada Town (Kadirganj) P.S. Case No. 526 of 2011, corresponding to Sessions Trial No. 71
Patna High Court Cr.Misc. No.3167 of 2014 (13) dt.16-04-2015 2/2 of 2012/09 of 2012, registered for the offences punishable under Sections 302, 436, 120B and 34 of the Indian Penal Code. It is submitted that the case is pending since long and a report was called for. The trial court has reported that the case was likely to be concluded within two months even then the trial could not be concluded. Thereafter again a report was called for. The learned 4th Additional Sessions Judge, Nawada reported that the prosecution evidence has been closed and the case was posted for argument but accused Yogendra Singh filed a petition for adducing defence witnesses and the case was fixed for rejoinder. The court also reported that the case is likely to be concluded within two months.
Considering the facts that the court has already reported that the case is likely to be concluded within two months vide report dated 10.04.2015, the learned Additional Sessions Judge, Nawada is directed to hear the case on day to day basis and conclude within two months.
With the aforesaid observations both the bail petitions are dismissed.
