JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but it appears from perusal of the impugned order that in course of investigation, one witness namely, Ram Kripal Raut claimed to have seen the petitioner and others fleeing towards village Barahi at the time of alleged occurrence and subsequently, some witnesses stated about the participation of the petitioner in the alleged crime and, thereafter, petitioner was arrested and confessed his guilt. It appears that except the aforesaid material, there is nothing against the petitioner, who is languishing in jail custody since 31.07.2015.

Accordingly, let the petitioner, above named, be

Patna High Court Cr.Misc. No.4571 of 2016 (2) dt.10-02-2016 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate- III, Sitamarhi in connection with Riga P.S.Case No. 146 of 2015.
