JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-06-2022 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor representing the State. The petitioners apprehend arrest in a case registered for the offence punishable under section 420 and other ancillary sections of the Indian Penal Code.

It is alleged in the F.I.R. that contrary to the guidelines issued by the Government, these petitioners made advance and transferred the money in the account of contractor and the work has not been completed as yet.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. There is no allegation of misappropriation of money or playing fraud against the petitioners. Work has also been

In the facts of the case, prayer for bail of the petitioners is allowed. In the event of arrest/surrender, let the petitioners mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in Luxamipur Police Station Case No. 426 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
