Petitioner seeks regular bail in connection with Rajoun (Nawada Bazar) P.S. Case No. 46 of 2021 registered for the offence under Section 341, 323 , 307 of the I.P.C. and Section 27 of the Arms Act.

Petitioner has allegedly fired upon the informant due to which she sustained injury in her left arm. Learned counsel for the petitioner submits that petitioner is the nephew of the husband of the informant and there is land dispute between both the parties. He further submits that petitioner has got no criminal antecedent, he is in custody since 02/03/2021, charge sheet has already been submitted and trial is not likely to be concluded in near future .

No.43135 of 2021(2) dt.03-02-2022 2/2 Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that both the parties are close relatives, petitioner is the nephew of the informant's husband, petitioner is having no criminal antecedent, he is in custody since 02-032021, charge sheet has already been submitted and trial is not likely to be concluded in near future due to Covid 19 pandemic, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajoun (Nawada Bazar ) P.S. Case No. 46 of 2021.
