JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-01-2021 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 05.03.2020 in connection with Mufassil P.S. Case No. 112 of 2020 registered for the offences punishable under Sections 363, 366 A of the Indian Penal Code.

Admittedly, victim was recovered in course of investigation and her statement under Section 164 of the Cr.P.C. was recorded. Furthermore, it is an admitted position that victim was examined by the medical board and she was found aged about 18 years and, therefore, it is obvious that victim was major at the time of alleged occurrence.

Learned counsel of the petitioner submits that as a

No.32055 of 2020(3) dt.11-01-2021 2/2 matter of fact, victim and petitioner were in love and they solemnized their marriage in a temple but subsequently, under the pressure of her family members, the victim took U-turn when her statement under Section 164 of the Cr.P.C. was recorded.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge V cum Additional Chief Judicial Magistrate-II, Samastipur in connection with Mufassil P.S. Case No. 112 of 2020.
