JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-04-2015 Learned counsel for the petitioner seeks permission to make necessary correction in Para-14 of the petition. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be the husband of the deceased, who died in mysterious circumstances within one year of her marriage. In course of investigation, witnesses stated that an altercation had taken place between the petitioner and deceased and thereafter, deceased committed suicide.
Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to grant privilege of bail to the petitioner and accordingly, his prayer for bail in connection with Barh P.S.Case No. 343 of
Patna High Court Cr.Misc. No.50988 of 2014 (4) dt.02-04-2015 2/2 2013,pending in the court of Learned Additional Chief Judicial Magistrate, Barh stands rejected However, learned Additional Chief Judicial Magistrate, Barh is directed to commit the case of the petitioner to the court of session in accordance with law within four weeks from the date of receipt/ production of copy of this order and after commitment, the concerned session court shall expedite the trial of the petitioner and try to conclude the same as early as possible.
