The petitioners apprehend their arrest in connection with Dumraon P.S. Case No.402 of 2015 for offences punishable under sections 341, 323, 307 and 504/34 of the Indian Penal Code.

Mr. Rakesh Kumar Sharma, learned counsel appearing for the petitioners with reference to Annexure-2 submits that the case in question is in retaliation to the case filed by the petitioners bearing Dumraon P.S. Case No.401 of 2015 which has resulted in the death of the uncle of the petitioner no.1. Reverting back to the FIR in question placed at Annexure1 he submits that the allegation is omnibus and general in nature.

Patna High Court Cr.Misc. No.4729 of 2016 (2) dt.16-03-2016 He submits that in a sweeping manner these petitioners have been charged with assault on the informant and although some allegation is made against accused Arun Kumar Pandey but he is not the petitioner before this Court.

Having heard learned counsel for the parties and considering the nature of the circumstance, let the petitioners, namely, Ved Vyas Pandey, Krishna Kumar Pandey and Kamalapati Pandey in the event of their arrest or surrender within four weeks from today be released on bail upon each of them furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Dumraon P.S. Case No.402 of 2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
