JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The trial court has reported that altogether ten prosecution witnesses have already been examined and it appears from the report of trial court that the trial of the petitioner is going on in full swing and, therefore, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 32 of 2011/135 of 2011 arising out of Magadh University P.S. Case No. 58 of 2010 pending in the court of Ad hoc Additional Sessions Judge-I, Gaya is again rejected. However, the trial court must expedite the trial of the petitioner even by taking the trial of the petitioner on day to day
Patna High Court Cr.Misc. No.51127 of 2014 (3) dt.28-01-2015 basis and conclude the same as early as possible, preferably within four months from the date of receipt/production of copy of this order. Any failure on the part of learned Ad hoc Additional Sessions Judge-I, Gaya shall be viewed seriously. Let copy of this order be sent to Superintendent of Police, Gaya with direction to him to ensure the presence of remaining prosecution witnesses of Sessions Trial No. 32 of 2011/135 of 2011 arising out of Magadh University P.S. Case No. 58 of 2010 before the court of Ad hoc Additional Sessions JudgeI, Gaya within a month from the date of receipt/production of copy of this order, failing which stern action will be taken against the concerned Superintendent of Police, Gaya.
