The petitioner seeks bail in connection with Sadar (Mabbi O.P.) P.S. Case No. 338 of 2019, dated 12.09.2019, instituted for the offence under Section 304(B) of the Indian Penal Code.

The petitioner is the husband of the deceased. Though several grounds have been raised by the counsel for the petitioner while canvassing for bail, but I

The prayer for grant of regular bail of the petitioner is, accordingly, rejected.

However, looking at the fact that the petitioner is in custody since 28.05.2020 and that there are two children born out of the wedlock of the petitioner with the deceased, who need to be fended for, this Court directs that the trial of this case be expedited and concluded within a period of one years from the date of receipt/production of a copy of this order.

If there is no substantial progress in the case within the next nine months, it would be open for the petitioner to approach the Trial Court for grant of bail. In that event, the Trial Court shall be required to state the reasons for the tardy progress of the trial.

The application stands dismissed.
