The petitioner seeks bail in a case for the offences punishable under sections 366 of the I.P.C Allegedly the petitioner and one Shahin kidnapped the daughter of the informant when she has gone out to attend call of nature. The victim girl in her statement recorded under section 164 Cr.P.C. has stated the name of the petitioner that the petitioner and Shahin kidnapped her and took away at Delhi after making her unconscious.
Submission is of false implication and that the informant is not an eye witness and only on suspicion the petitioner has been named and without any legal or cogent
Patna High Court Cr.Misc. No.52114 of 2014 (3) dt.04-03-2015 2/2 evidence the petitioner is suffering in custody since 05.08.2014, to which the learned A.P.P. opposes.
Considering that the victim has stated the name of the petitioner regarding her kidnapping in her statement recorded under section 164 Cr.P.C and as such at this stage this Court is not inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner stands rejected in connection with Araria (Bairgachhi) P.S. Case No. 315 of 2014 pending in the court of C.J.M. Araria.
