JUSTICE ARUN KUMAR ORAL ORDER 10-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 11.1.2017 seeks bail in Kotwali (Tilkamanjhi) PS Case No. 527 of 2015 registered under Sections 419, 420, 467, 468 and 471 of the IPC. The allegation in brief is that ATM of the informant was exchanged fraudulently while taking help from one strantger, later on he went to again withdraw money then found that entire 1,96,000/- rupees was withdrawn by using his ATM, during investigation it transpired that by using the ATM 36,000/- rupees was transferred in the account of the petitioner and later on it was withdrawn by using the ATM.

Learned Counsel for the petitioner submits that the petitioner has not withdrew the amount rather fact is that his ATM was also exchanged by some one, however he admits that no information regarding missing of the ATM was given to the police. Having considered the evidence on record the Court is not persuaded to grant bail to the petitioner.

The application for bail stands rejected. However the trial court is directed to expedite the trial and preferably conclude the same within a period of six months.
