2. The petitioner seeks regular bail in connection with Sakra P.S. Case No. 36 of 2026 lodged on 17.01.2026, for the offence punishable under Section 137(2) of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in brief, is that on 15.01.2026 at about 10 PM the informant's son Manish Raj left his house to buy medicine but did not return back. His mobile phone was switched off. Apprehension was expressed that some unknown persons have kidnapped him. Later, dead body of Manish Raj was found.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned

No.34188 of 2026(3) dt.23-07-2026 2/3 counsel for the petitioner further submits that the criminal antecedent of the petitioner is clean and he is in custody since 20.01.2026. Counsel lastly submits that the name of the petitioner has surfaced in this case on the confessional statement of co-accused.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that the petitioner was actively participated in the crime and he was part of the team.
6. Perused the record and case diary. After perusal of the case diary and taking into the fact that the petitioner's name has surfaced on the confessional statement merely on suspicion and coupled with the fact that the Co-ordinate Bench has granted bail to the other co-accused, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the likewise amount each to the satisfaction of learned Additional Chief Judicial Magistrat-XV, Muzaffarpur in connection with Sakra P.S. Case No. 36 of 2026, subject to the following conditions:
(I) One of the bailors shall be the petitioner's own or close member.
(II) The petitioner shall appear on each and every date
Patna High Court CR. MISC. No.34188 of 2026(3) dt.23-07-2026 3/3 fixed during the trial and also co-operate in the process of trial. (III) The petitioner shall not tamper with the prosecution evidence or influence/intimidate any witness during the course of trial.
(IV) The Petitioner shall not commit offence of a similar nature in future.
In case of violation of any of the aforesaid conditions, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
