This application has been filed for modification of the order dated 05.03.2020 passed in Cr. Misc No. 65189 of 2019. In this case, the petitioner has drawn attention of this Court that the order of the Court for payment of Rs. 31,000/- could not be carried out in view of the fact that the bank account is reported to be closed by the Bank Manager, as mentioned in Annexure-2 of this application.

In such view of the matter, this Court directs the court below to give notice to the informant, Sri Vijay Yadav, who has lodged an F.I.R. and after his appearance, the petitioner will hand over the draft of Rs.31,000/- to Sri Vijay Yadav and obtain

Patna High Court CR. MISC. No.7690 of 2021(2) dt.08-02-2021 2/2 the receipt of payment of said amount and the copy of the same would be brought before the Court for information. If the aforesaid amount is paid to the informant, Sri Vijay Kumar by the petitioner, the provisional bail granted to the petitioner will be confirmed.

The order dated 05.03.2020 passed in Cr. Misc No.65189 of 2019 is modified to the aforesaid extent. This order has been passed in presence of Mr. Anand Kumar representing the State.
