JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.
The petitioner has been made accused in this case on the ground that the victim used to talk on cell phone of the petitioner and SIM of the aforesaid cell phone had been issued in the name of the petitioner. In course of investigation, almost all the witnesses supported the above stated story but none of the person claimed to have seen the petitioner on the alleged date of occurrence nor any other circumstance has been brought on the record to show the involvement of the petitioner in connection with the present case.
No doubt, petitioner is said to have escaped from the
Patna High Court Cr.Misc. No.50650 of 2014 (4) dt.01-04-2015 2/2 police custody but for that offence a separate case has been registered against him Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kotwali Barari P.S.Case No. 335 of 2014.
