The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 467, 468, 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on information having been received, a raid was conducted and a total of 3833.280 litres of liquor was recovered and five persons were taken into custody besides the vehicle.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for the reason that his alleged Bolero vehicle bearing registration no.BR 06PC-0612 is said to have been caught in the occurrence.

The petitioner was not caught at the place of occurrence and has no concern with the seized liquor. He is in custody since 10.6.2021 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case including the petitioner having remained in custody for 7 months, the Court directs the petitioner to be enlarged on bail in connection with Sakra P.S. Case no.556 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
