JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-01-2015 Heard leaned counsel for the petitioner and the State. The petitioner is languishing in custody since 28.06.2014 in a case registered for the offence punishable under section 395 of the Indian Penal Code.
Accusation is looting of tractor . Petitioner's name has sprung up in the confessional statement of co-accused made during the course of investigation. It is submitted that the petitioner has not been put on T.I.P till date in spite of the petition filed by the petitioner and statement to this effect has been made in paragraph 6 of the petition. There is no recovery of the tractor. Petitioner is accused in another case of similar nature in which he is on bail.
Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.52077 of 2014 (2) dt.08-01-2015 petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Additional Chief Judicial Magistrate, Naugachia in connection with Parbatta P.S.Case no. 2 of 2014. The learned court below is will be at liberty to cancel the bail bond of the petitioner, if he is found involved in some serious nature of offence.
