ANJANA MISHRA ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 04.01.2016 in connection with Ghanshyampur P.S. Case No. 261/2013, registered for the offences punishable under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is case and counter case between the parties and that the allegation against the petitioner is that he had inflicted talwar blow on the head of the informant. It is further submitted that there is no injury caused by talwar. The doctor has found only two injuries caused by hard blunt substance.

Considering the facts that there is case and counter case and that the petitioner has no criminal antecedent, let the petitioner
