The petitioner seeks bail in anticipation of his arrest in connection with Mansi P.S. Case No. 229 of 2018 dated 17.11.2018 instituted for the offences under Sections 307, 326, 354, 307, 323, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act. A minor girl was attacked in her eye by one Mritunjay Mandal. The complaint petition which is the basis of the subject FIR further discloses assault by several other persons to the members of the family of the informant.

Learned counsel for the petitioner has submitted that though the petitioner has been arraigned

Patna High Court CR. MISC. No.32537 of 2020(2) dt.19-02-2021 2/2 in the column of the accused persons, but in the body of the FIR, there is no reference of the petitioner as having played any overt act.

Apart from this, it has been submitted that there was dispute between the two girls of the neighbourhood in which the elders have put their feet into.

Considering the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No. 229 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
