The petitioner is in custody since 07.12.2015 in connection with Pranpur P.S. Case No.93/2015 for the offences punishable under Sections 341,323,324, 379, 307, 504, 506 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner is general and omnibus in nature and he is a handicapped person having around 45 percent disability. It is further submitted that the petitioner Rajendra Yadav along with others had assaulted the informant. However, the injuries have been found to be simple in nature. It is further submitted that the son of the petitioner had filed a case against the
Patna High Court Cr.Misc. No.3703 of 2016 (2) dt.08-02-2016 petitioner and this is a counter blast of that case. Considering the aforementioned facts and circumstances of the case and also that the petitioner is a handicapped persons , let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Katihar, in connection with Pranpur P.S. Case No.93/2015.
