JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner happens to be husband of the deceased and in course of investigation, almost all the witnesses stated that the petitioner has solemnized his love marriage with the deceased and on the alleged date of occurrence, some altercation had taken place, as a result of which, the deceased consumed poison and died in course of her treatment.

Furthermore, it would appear from the first information report as well as statement of witnesses that the informant got information, regarding the above-said incident but he lodged this case in haste. Moreover, after

Patna High Court Cr.Misc. No.16125 of 2015 (3) dt.03-07-2015 2/2 investigation, police submitted charge sheet under Section306 of the Indian Penal Code. Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Desari P.S. Case No. 188 of 2011 to the satisfaction of Smt. Niharika, J.M. Ist Class, Vaishali at Hajipur.
