ANJANA MISHRA ORAL ORDER 08-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is in custody since 06.08.2015 in connection with S.Tr. No. 477 of 2015 arising out of Dhanha P.S. Case No. 62 of 2015, for the offences punishable under Sections 341, 323, 325 and 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that entire case against the petitioner is false and concocted and if at all there is any allegation, it is against one Ramdhari Chauhan who is said to have attacked Chottelal Chauhan, and not against the present petitioner. There is specific allegations against the Ramdhari Chauhan. The others who are named in the F.I.R. have been leveled with allegations which are general and omnibus in nature.

No.3669 of 2016 (2) dt.08-02-2016 2/2 Considering the aforementioned facts and circumstances and that the petitioner is not said to have attacked the deceased Chottelal Chauhan and also the fact that the petitioner has a clean antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Bagaha, District- West Champaran, in connection with S.Tr. No. 477 of 2015 arising out of Dhanha P.S. Case No. 62 of 2015.
