This application for grant of regular bail arises out of Special (POCSO) Case No. 39 of 2020 arising out of Banmankhi P.S. Case No. 148 of 2020, disclosing offences punishable under Sections 448,341,323,427,354B,379,506/34 of the Indian Penal Code and Section 12 of the POCSO Act. Two persons have been named in the First Information Report, who allegedly entered into the house of the informant at about 4 P.M. on the alleged date of occurrence and attempted to outrage her modesty. They are said to have assaulted the informant's sister also, who had come in rescue. From the case diary, it appears that the main allegation is against co-accused Awadhesh Kumar, who has been

Petitioner is in custody since 19.06.2020.

On perusal of the order dated 22.01.2021, I do not find any circumstance why a different view should be taken in case of the petitioner. This application is accordingly allowed. Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned 8th Additional Sessions Judge-cum-Special Judge (POCSO) Act, Purnea in Special (POCSO) Case No. 39 of 2020 arising out of Banmankhi P.S. Case No. 148 of 2020.
