2. This is the second attempt of the petitioner for grant of regular bail in connection with S.Tr. No. 710 of 2024 arising out of Shikarpur P.S. Case No. 360 of 2024 registered for the offence under Sections 304(B)/34 of the Indian Penal Code. Earlier the bail application of the petitioner was rejected vide order dated 5.3.2025 passed in Cr. Misc. No. 85824 of 2024.

3. As per the prosecution case, the petitioner is accused of killing his wife.

4. The petitioner is in custody since 8.7.2024.

5. It has been submitted by the learned counsel for the petitioner that the deceased was seriously ill and was treated in a hospital at Gorakhpur where she died. He further submits

6. Learned counsel for the State Mr. Jharkhandi Upadhyay has opposed the prayer of the petitioner and has submitted that the deceased was killed within three years of her marriage.

7. Considering the period of custody of the petitioner and the delay in trial, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below in connection with S.Tr. No. 710 of 2024 arising out of Shikarpur P.S. Case No. 360 of 2024. (Sandeep Kumar, J) Vikas/- U
