The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

Petitioner who happens to be Panchayat Secretary Jhikatia is said to have appointed 15 persons as Panchayat Teacher in the year 2005 on the basis of the documents furnished by the candidates. Subsequently, the document furnished by the candidates was found to be forged after its verification. Aforesaid teachers withdrew salary for 14 years causing great loss to public coffer.

No.33332 of 2019(2) dt.23-08-2019 2/2 It has been submitted on behalf of the petitioner that the petitioner has no concern with the aforesaid occurrence and has been falsely implicated in this case. He further submits that similarly co-accused has been granted the privilege of anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No. 28969 of 2019 on 06.08.2019.

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, IX, Gaya in connection with Magadh University Police Station Case No. 126 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
