JUSTICE MUNGESHWAR SAHOO ORAL ORDER 19-04-2017 Heard learned counsel for the appellant-State of Bihar on the Interlocutory Application No.1806 of 2001. This is a limitation application filed by the appellantState of Bihar praying for condoning the delay in filing the first appeal. Notices were issued to the sole respondent in limitation matter. After notice the sole respondent has appeared by filing vakalatnama but today nobody appeared to oppose the prayer for condoning the delay.
In view of the submission of the learned counsel for the appellant and the explanation given in the limitation application, I am satisfied that the appellant was prevented by sufficient cause from not filing the first appeal within the limitation prescribed. Accordingly, the delay in filing the first appeal is condoned. Limitation Application stands allowed. The learned counsel submitted that appearance slip of
Patna High Court FA No.715 of 2000 (11) dt.19-04-2017 S.C.18 has already been filed in this first appeal but still today it is printed as S.C.11 in the daily cause list. The office shall verify and correct the name and designation of the State Counsel. (Mungeshwar Sahoo, J) Harish/- U
