JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 12-08-2015 on the accusation that having entered into house of the informant, made attempt to commit rape upon her but submission on behalf of the petitioner is that even if, prosecution story assumed to be true, then also, the offence of attempt of rape is not constituted and moreover, investigation of the case has already been completed and petitioner is in custody since long.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection
