The petitioner is languishing in custody since 15.12.2014 in a case registered for the offences punishable under Sections 365, 364, 302 and 201/34 of the Indian Penal Code. It is alleged that the father of the informant went to sell fish in the company of this petitioner, after his return he again went outside, thereafter he went traceless. Suspicion was raised against the daughter of the neighbour of the informant Fulo Devi, who gave life threatening prior to the victim went traceless. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.13049 of 2015 (02) dt.03-04-2015 2/2 petitioner that only on suspicion the accusation has been levelled. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. The impugned order also does not suggest any direct evidence connecting the petitioner with the crime.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Manihari P.S.
