2. Learned counsel for the appellant outrightly fairly submits that order of cognizance dated 15.12.2022 was challenged in Cr. Appeal (SJ) No. 1926 of 2023 and the appellant has granted stay vide order dated 26.07.2023 and hence apprehension of arrest at present is no more and accordingly, he seeks permission to withdraw the present appeal with liberty that whenever the apprehension of arrest may arise, he may move before this Court.
