2. This is the 2nd attempt of the petitioner. Earlier the prayer for bail was disposed of as withdrawn vide order dated 09.11.2023 passed in Cr. Misc. No. 72857 of 2023.

3. The petitioner seeks regular bail in connection with Phulwarisharif P.S. Case No. 1499 of 2022 registered for the offence under Sections 399, 402, 411, 412, 413, 414 of the Indian Penal Code and under Sections 25(1-B)A, 26 and 35 of the Arms Act as well as under Sections 8(c), 21(b) of the NDPS Act.

4. As per the prosecution case, the allegation against the petitioner and others is that on 06.12.2022, they have been arrested with arms, smack, looted motorcycles etc., while

5. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. He further submits that the petitioner is in custody since 06.12.2022.

6. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

7. Considering the facts and circumstances of the case as well as the submission of the learned counsel for the petitioner, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below, Patna in connection with Phulwarisharif P.S. Case No. 1499 of 2022.
