JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 6.1.2015 in a case registered for the offences punishable under Section 379 of the Indian Penal Code. Later on, section 136 of the Electricity Act was added.

It is alleged that three transformers worth Rs.1,62000/- were stolen. During investigation, the investigating agency found Niyaz Dewan and Amjad Ali being involved in committing the theft of transformers who were apprehended and confessed their guilt and in their confession name of the petitioner transpired. It is submitted by the learned counsel for the petitioner that except the confession there is nothing against the petitioner

Patna High Court Cr.Misc. No.15012 of 2015 (2) dt.12-05-2015 2/2 and there is no recovery from the petitioner though the petitioner is accused in for similar cases. It is further submitted that investigation has already concluded and co accused Niyaz Dewan has been granted bail vide Cr. Misc. No. 8971 of 2015. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Bagaha in connection with Bagaha (Patkhauli) P.S. Case No. 309 of 2014.
