The petitioner is languishing in custody since 02.10.2015 in a case registered for the offences punishable under Sections 8/20(b)(II) of NDPS Act.

It is alleged that about three kgs. Ganja were recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that the recovery has been made from the joint family house and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The investigation has already concluded, though, the Final Report has submitted without the FSL report.

No.5171 of 2016 (2) dt.03-02-2016 2/2 Considering the fact that investigation has already concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Special Case No. 109 of 2015 arising out of Shukhani P.S. Case No. 05 of 2015.
