====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 01-04-2022 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. for the State through video conferencing.

Let the defect(s) be removed within two weeks of the complete start of the physical Court in normal course. The petitioner, who is in custody since 15.11.2020, seeks regular bail in connection with Banka (Mahila) P.S. Case No. 29 of 2019, for the offence punishable under Section 498A/34 of the Indian Penal Code and Section 3/4 of the D.P. Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is ready to keep the informant with full dignity and honour and he will provide all financial as well physical desire and need of the informant.

Sri Sanjeev Kumar @ Dipak Sahay, learned counsel appearing on behalf of informant submits that the matter may be

Patna High Court CR. MISC. No.44150 of 2021(3) dt.01-04-2022 2/2 referred to the District Mediation Centre, Banka so that the matrimonial dispute between the parties may be resolved. Considering the aforesaid submissions of the parties, the petitioner, above named, is directed to be enlarged on provisional bail on such terms and conditions fixed by the learned Court below, so that the petitioner, who is the husband of the informant, and O.P. No.2 may strive to enter into some amicable terms and conditions and start their happy matrimonial life so as to go away strained relationship, which has laid the petitioner to undergo custody for more than one year.

If the District Mediation Centre is not functional then the court below shall, on its own, strive to bring the two misdirected persons, who have strained their matrimonial relationship to arrive at any amicable terms, if the conduct of the parties are conducive and the complainant does not make any complaint, the provisional bail of the petitioner shall be confirmed preferably after a period of one year or if required further time the provisional bail may be extended to such period as deem fit and proper by the learned Court below.

With the aforesaid observations and directions, this application is disposed of.
