The petitioner being the uncle of the husband of the victim is languishing in custody since 04.02.2015 in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

The accusation is of killing the niece of the informant within 11 months of the marriage for non-fulfillment of the dowry demand. The dead body of the victim was recovered wrapped in a blanket from a well adjacent to the village of the accused persons.

It is submitted by learned counsel for the petitioner that the accusation is not specific against the petitioner .

Patna High Court Cr.Misc. No.15038 of 2015 (02) dt.12-05-2015 2/2 The petitioner claims himself to be separate from the husband of the victim when the accusation of demand of dowry is specific against Shyam Yadav and Sagar Yadav, the brothers of the husband of the victim.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Banka in connection with Belhar P.S.
