JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-04-2015 Petitioner is languishing in custody since 09.02.2015 in a case registered for the offences punishable under Sections 323, 380, 384, 452 of the I.P.C and Section 27 of the Arms Act.
It is alleged that extortion demand of rupees three lacs were made from a construction company when Rs. 22,000/-, mobile and other articles were robbed. The name of the petitioner sprang up during investigation. It is submitted by learned counsel for the petitioner that neither any recovery has been made from the petitioner nor the petitioner has been put on test identification parade. A statement to that effect has been made in para 7 of the petition.
Considering the fact that petitioner has not been put on test identification parade, let the petitioner, above
Patna High Court Cr.Misc. No.13909 of 2015 (2) dt.10-04-2015 2/2 named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 89 of 2010.
Since the petitioner is accused in two other case, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for three consecutive occasions during trial.
