JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Bhairabsthan P.S. Case No. 65 of 2014 registered for the offences punishable under sections 302 and 201 read with 34 of the Indian Penal Code.

It has been contended that admittedly the petitioner was married to the deceased in the year 2005 and he is having three children from the wedlock with the deceased. On the alleged date of occurrence, when the deceased met with an accidental fire, she was immediately taken to hospital and in course of treatment she died. The daughter of the deceased has stated in course of investigation that at the time of occurrence she was in the garden

Patna High Court Cr.Misc. No.51737 of 2014 (3) dt.03-03-2015 2/2 along with her grandmother and upon hearing hulla the petitioner came from the chowk.

On the other hand, learned counsel for the State has opposed the prayer for bail. He has submitted that it has come in the case diary that some quarrel had taken place between the petitioner and his wife as a result of which the victim set herself on fire.

Be that as it may, regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Jhanjharpur in connection with Bhairabsthan P.S. Case No. 65 of 2014.
