JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have been caught along with two others and it is alleged that petitioner and his associates took out Rs. 2200/- from the pocket of the informant and tried to flee from there but they were caught by the informant and on search, one piece of blade and one mobile was recovered from conscious possession of the petitioner. Petitioner does not have any criminal antecedent and is languishing in jail custody since 06.12.2015. Moreover, there is nothing on the seizure list to show that stolen cash was recovered from conscious possession of the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.4238 of 2016 (2) dt.10-02-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Sonepur in connection with Rail Sonepur (Hajipur) P.S. Case No. 65 of 2015.
