The petitioner being the husband of the complainant is languishing in custody since 20.09.2014 in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 498A of the Indian Penal Code and 4 of Dowry Prohibition Act. Though the petitioner was also remained in custody for two months as the petitioner was released provisionally by the learned court below.

The basic accusation is of torture for non-

Patna High Court Cr.Misc. No.52130 of 2014 (03) dt.03-03-2015 2/2 fulfillment of the dowry demand.

Considering the nature of accusation and the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Complaint Case No. 14 of 2009.
