JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 15-04-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has renewed his prayer for bail in connection with Dehri (Dalmiyanagar) P.S.Case No.22 of 2014 registered for the offences punishable under sections 25(1-B)(a), 26 and 35 of the Arms Act.

The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 26th September, 2014 passed in Cr.Misc. No. 34412 of 2014 with the following observations :- "The learned S.D.J.M., Dehri at Rohtas is directed to expedite the trial of the petitioner and conclude the same as early as possible preferably within a period of six months from the date of receipt/production of a copy of this order, failing which the petitioner

Patna High Court Cr.Misc. No.14672 of 2015 (2) dt.15-04-2015 2/2 would be entitled to renew his prayer for bail."

It has been contended that though the petitioner is in custody since 13th January, 2014 but till date only two out of seven witnesses could be examined on behalf of the prosecution in course of trial.

Regard being had to the observations made in the order dated 26th September, 2014 passed in Cr.Misc. No. 34412 of 2014, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisiional Judicial Magistrate, Dehri at Rohtas in connection with Dehri (Dalmiyanagar) P.S.Case No. 22 of 2014.
