JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 395/120B and other ancillary sections of the Indian Penal Code. As per the prosecution case, unknown miscreants looted cash of Rs.43 lacs from the van of the bank.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused Rakesh Giri who has also been allowed bail by a co-ordinate bench of this Court vide para 6 of the bail petition. No incriminating material has been recovered from the conscious possession of the petitioner. Test Identification Parade has not been carried out till date. Patna High Court CR. MISC. No.43230 of 2021(2) dt.01-11-2021 2/2 has also been allowed bail vide para 12. He is in custody since 26.3.2021.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Madanpur Police Station Case No. 173 of 2013.
