Petitioner seeks bail in a case under Section 307 and other sections of the IPC.

Petitioner is not named in the F.I.R. The informant named Shashi Mahto, Sonu Mahto, Umesh Mahto etc. and alleged that on account of non-payment of extortion money, the accused persons assaulted him.

It is submitted that the name of the petitioner figured in the confessional statement of co-accused Sanjay Giri whose name was also figured in the confessions statement of co-accused but he has already been granted bail by 3rd Additional Sessions Judge Samastipur vide order dated 2.12.2014. The case of the petitioner stands on similar footing.

Considering the facts that the name of the petitioner figured in the confessional statement of co-accused and no tangible evidence has been collected against him, the petitioner, named above, is directed to be enlarged on bail on furnishing

Patna High Court Cr.Misc. No.8114 of 2015 (2) dt.02-03-2015 bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rosera, Samastipur in connection with Rosera P.S.Case No.183 of 2014.
