JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in Complaint Case No. 104 of 2014 in which cognizance has been taken for the offence punishable under section 498-A of the Indian Penal Code and section 4 of Dowry Prohibition Act.

It has been contended that there is no truth behind the allegation of subjecting the complainant to cruelty for demand of dowry. The complaint has been filed due to matrimonial discord and incompatibility and the petitioner is in custody for the last five months.

Learned counsel for the State has opposed the prayer

Patna High Court Cr.Misc. No.51562 of 2014 (2) dt.03-03-2015 2/2 for bail.

Regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bikramganj, Rohtas (Sasaram) in connection with Complaint Case No. 104 of 2014.
