The petitioner is languishing in custody since 05.12.2014 in a case registered for the offences punishable under Sections 354 of the Indian Penal Code and 12 of Protection of Children From Sexual Offences Act, 2012.
It is alleged that while taking mid-day meal in the school the petitioner being the Headmaster outrage the modesty of the informant, who is a student of Class-V. It is submitted by learned counsel for the petitioner that the informant has retracted from the initial version and filed a petition to that effect before the learned court below.
Patna High Court Cr.Misc. No.5523 of 2015 (02) dt.13-02-2015 2/2 A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the retracted version of the informant, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist, Gaya in connection with POCSO Trial No. 28 of 2014 arising out of Magadh Medical College Hospital P.S. Case No. 175 of 2014.
