JUSTICE DINESH KUMAR SINGH ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 26-11-2019 The appellant has filed the memo of appeal with a prayer to set aside the judgment and order dated 2.4.2019 passed in CWJC No.982/2018 (Devanti Devi Vs. The State of Bihar & Ors.) by a learned Single Judge of this Court and consequently direct the respondent's authority to pay the reduced amount of construction with interest as per statute till the period of payment of the reduced amount of valuation of the construction in award.

Learned counsel for the appellant states that the present appeal be permitted to be withdrawn in the light of the

Patna High Court L.P.A No.545 of 2019(3) dt.26-11-2019 2/2 order dated 15.11.2019, passed in L.P.A. No.547 of 2017 (Devanti Devi Vs. The State of Bihar & Ors.) which reads as under:

"Mr. Nagendra Sharma, learned counsel for the appellant seeks permission to withdraw the present appeal with a liberty to seek remedy before appropriate authority.

Permission is granted.

Accordingly, the instant appeal stands dismissed as withdrawn with above mentioned liberty to the appellant.

However, it is expected from the concerned authority to conclude the exercise within a period of two weeks."
