The petitioner seeks bail in Bhagwanpur P.S. Case No. 171 of 2014 registered under sections 302 and 120-B/34 IPC. The accused persons including the petitioner named in the FIR are said to have arrived at the scene of occurrence and three shots were fired at the deceased. Further allegation is that the petitioner along with another lady assaulted the deceased after he fell down with sharp cutting weapon(s).

Counsel for the petitioner drawing attention of the Court to the post mortem report (annexure-4) submits that there is no corresponding injury on the person of the deceased caused by

Patna High Court Cr.Misc. No.14676 of 2015 (3) dt.22-06-2015 2 / 2 sharp-cutting weapon(s). All the injuries were found to have been caused by the fire-arms. It is submitted that the petitioner is in custody since 13.12.2014.

In the facts and circumstances of the case, the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M. Bhabhua in Bhagwanpur P.S. Case No. 171 of 2014 on condition that one of the bailors of the petitioner shall be his own/close family member. No sooner the charges are framed, the petitioner shall appear in person on each date fixed at the trial. In case of default in appearance on two consecutive dates the trial court shall cancel his bail bonds.
