The petitioner seeks bail in Akbarpur P.S. case No. 291 of 2014 under Section 420, 467, 471 of the Indian Penal Code. The prayer of petitioner for bail was earlier rejected by this court vide order dated 13.04.2015 passed in Cr. Misc. No. 7310 of 2015 with a direction to the trial court to expedite the trial and conclude the same within nine months.

The trial court has reported that the case is pending for evidence and he will dispose of the case within two months. The learned counsel for the petitioner submits that till date the case has not been disposed of nor any prosecution witness has been examined. The petitioner is in custody since 18.10.2014 and he has already remained in jail for one year and nine months.

No.4686 of 2016 (5) dt.27-07-2016 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Akbarpur P.S. Case No. 291 of 2014 subject to condition that the petitioner shall appear on each and every date during the course of trial and he shall not absent in the proceeding of trial court for two consecutive dates without any plausible reason.
